This visa category allows a person to come into the UK to set up a business, invest into an existing business or take over a business. An applicant would be required to show amongst others that; they have access to an investment sum of £200,000 or £50,000(if investment fund is from specified entities listed in the rules). Tier 1 Entrepreneur is one the most complex UK Visa routes. Most Home Office refusals in this category are due to inability of the applicant to demonstrate with specified documentary evidence; what business they intend to do and how the £200,000 investment fund would be utilized for the business.

The initial Tier 1 Entrepreneur visa will be granted for three years which can be extended leading to Indefinite Leave to Remain (ILR). Eligible dependants (spouse and children under 18 years) may also qualify to be included and upon obtaining the visa, they may also work or study without any restrictions and use NHS.
There is an accelerated route to settlement as a Tier 1 Entrepreneur after 3 years if applicant has created at least 10 new full-time jobs or the business has a turnover of at least £5 million.
To also qualify for ILR as a Tier 1 Entrepreneur, an applicant would be expected to spent not more than 180 days outside the UK in any rolling 12-month period and, unless aged 65 or over, they must have sufficient knowledge of the English language and Life in the UK. For settlement applications made in the UK from 11 January 2018, the Home Office will consider absences from the UK on a rolling basis, rather than in separate consecutive 12-month periods. If your qualifying period includes time before this date and you believe that this change would cause you exceptionally harsh consequences, you would be required to provide reasons.
ILR status entitles individuals to permanent residency in as well as visa-free travel to and from the UK. ILR holders may also be able to sponsor their non-British relatives into the UK and may also ultimately be eligible to apply for British citizenship.
